TERMS & CONDITIONS

Briton Consultancy & Travel Tours - Terms and Conditions

We are pleased to serve as your booking agent for your travel needs. The following terms and conditions outline what you can expect when purchasing travel-related services through us. These conditions also outline your obligations to us and our suppliers.

1. Service and Suppliers

We offer a range of travel packages from different suppliers and service providers. Each supplier has their own terms and conditions that apply to your arrangements, in addition to our general terms and conditions. Please note that we act as an intermediary for services not directly provided by us, such as air travel, ground transportation, accommodation, meals, tours, and cruises. It's important to be aware that airlines may impose price increases before the date of purchase, and we may need to pass on these additional costs to you. By accepting these terms and conditions, you consent to any post-purchase price increases and authorize us to claim the additional amounts.

2. Deposits, Payments, and Refunds

Please note that any deposits made are non-refundable. Full payment is required at least 45 days before your travel date. Failure to make full payment may result in the cancellation of your bookings. We accept cash, bank transfers, and cheques as payment methods. Refunds may take up to 30 working days and will be made directly to your bank account or by cheque. Please ensure all payments are settled within the agreed duration to avoid any disruptions to your bookings.

(i) Full payment for airline reservations will only be requested if it's close to the departure date. Once we receive a limit from the airline, we will notify you and you can proceed with the payment.

(ii) If you choose to make the full payment, we will be able to book everything for you and provide your vouchers within 72 hours or less—request your agent for this option.

(iii) Clients are required to pay a deposit for the package, which should be sufficient to cover hotels that require a deposit, such as in Dubai or during high/peak season.

3. Cancellations, Changes, and Force Majeure

We will promptly notify you of any significant changes before your departure. However, we cannot be held liable for changes or costs incurred due to natural calamities, force majeure events, or government actions.

Cancellation Policy:

If you decide to cancel your booking, the following charges will apply:

  • Admin Fee: An admin fee will be charged for all cancellations.
  • Supplier Fees: Additional charges may apply depending on the cancellation policies of airlines, hotels, and other suppliers. Some suppliers may impose non-refundable fees, which will be passed on to you.
  • Refund Processing: Refunds will only be processed once we have received the funds back from the supplier(s), which may take up to 30 working days.
  • Please note that certain bookings (e.g., non-refundable tickets or packages) may not be eligible for any refund. We recommend reviewing the cancellation policies of airlines and suppliers before making any bookings.

4. Group Bookings:

For group bookings (defined as 10 or more travelers on the same itinerary), the following additional terms and conditions apply:

(a) Group Leader Responsibilities:
The group leader is the primary point of contact for all communications with our agency. The group leader is responsible for:

  • Ensuring all group members are aware of and agree to these terms and conditions.
  • Coordinating with group members to provide accurate and timely information (e.g., names, passport details, special requests).
  • Ensuring all payments are made on time and in full.
  • Communicating any changes or cancellations to our agency promptly.

(b) Deposits and Payments:

  • A non-refundable deposit is required to secure the group booking. The deposit amount will be communicated at the time of booking.
  • Full payment for the group booking must be made at least 60 days before the departure date. Failure to make full payment by the deadline may result in the cancellation of the entire booking.

(c) Cancellations:

  • Groups Organized by Our Agency: If the group is organized by our agency (e.g., a tour package open to the public and joined by multiple individuals), the booking is non-refundable.
  • Groups Organized by a Group Leader: If the group is organized by a group leader (e.g., a private group booking for friends, family, or colleagues), the cancellation policy for the group will follow the same terms as an individual booking.

(d) Changes to Group Bookings:
Changes to group bookings (e.g., names, dates, or itineraries) are subject to availability and may incur additional fees.

(e) Group Conduct:
All group members are expected to behave respectfully toward each other, our staff, and local communities. Any disruptive or inappropriate behavior may result in the removal of the individual(s) from the group itinerary without refund.

5. Changes and Responsibilities

Reservation changes are subject to availability and the terms and conditions of the purchased package. Name changes are generally not allowed by airlines and other suppliers. It is your responsibility to ensure that all details, including names, are accurate before departure. Please note that flights must be taken in the sequence specified on your ticket. Failure to check in on time may result in extra charges or the cancellation of your entire flight itinerary. Any changes to departure and return dates may incur fees from airlines and an additional fee from our agency for reprocessing the change.

6. Your Responsibilities

It is your responsibility to check your travel documents, including passport validity (at least 6 months before departure) and visa requirements. We recommend reviewing any government prohibitions, warnings, and advisories for your destinations. Please check accommodation reviews, services, and room conditions before booking, as we are not responsible for the properties provided by suppliers.

7. Medical Conditions and Health

  • Any person with a medical condition is responsible for their own health and safety while traveling. You acknowledge and agree that you are responsible for managing your medical needs and any medical conditions during the trip.
  • It is advisable to bring an appropriate level of medical care with you (e.g., a nurse) if your condition is serious or requires ongoing attention. The decision to bring medical assistance is at your discretion and expense.
  • The company and its affiliates shall not be liable for any medical issues, treatments, or injuries arising from pre-existing conditions, or for any delays, missed activities, or other consequences related to medical conditions.
  • If you have a medical condition that could require urgent assistance, please inform your agent in advance so appropriate arrangements can be discussed, but this does not create liability for us if issues arise during travel.

Prescription Medications:

  • You must bring medications with the original prescription documents and, where applicable, a current doctor’s note or prescription. The prescription must be signed and stamped by a licensed medical professional.
  • Do not travel with medications that you do not have a valid prescription for, or that are not legally permissible in your destination.
  • Ensure you have an adequate supply of all prescribed medications for the duration of the trip, plus a reasonable запас for unexpected delays.
  • If you require controlled substances or special medications, check local regulations for entry and use at your destination and comply with all legal requirements.
  • If you foresee any medical needs that could impact travel (e.g., refrigeration, storage, or administration by a caregiver), inform your agent in advance so arrangements can be discussed. This does not create liability for us if issues arise during travel.

8. Carrying Passports and Personal Belongings

  • All personal belongings, including passports, wallets, and valuables, are the sole responsibility of the traveler. We shall not be liable for loss, theft, or damage to such belongings.
  • It is your responsibility to keep your documents and valuables secure at all times. Do not rely on the travel agency to safeguard these items.

9. Personal Issues and Disputes

  • Any personal issues, disagreements, or conflicts between travelers are the responsibility of the individuals involved. Do not involve the company or other members of the group in such matters.
  • We are not a mediator for personal disputes. If you experience interpersonal issues, handle them privately and professionally, and contact local authorities or your travel companions directly as appropriate.

10. Illegal Substances, Weapons, and Compliance

  • It is illegal to possess, transport, or use illegal drugs, controlled substances, or illegal weapons in Mauritius and in many other jurisdictions. You are solely responsible for ensuring that you do not bring or use any illegal substances or weapons on your trip.
  • Travelers who bring, attempt to bring, or use illegal drugs, controlled substances, or illegal weapons will be held fully responsible for all legal and financial consequences, including arrest, prosecution, fines, imprisonment, and any other penalties imposed by local authorities. The travel agency and its affiliates shall have no liability for any such legal actions or related damages.
  • The travel agency reserves the right to refuse service, cancel your booking, or remove you from any portion of the trip if there is any suspicion or evidence of illegal substances, illegal weapons, or unlawful activity, without refund.
  • You agree to cooperate with authorities and the travel company in any investigations or enforcement actions related to illegal substances, illegal weapons, or illegal activities.
  • This clause does not constitute legal advice. It is your responsibility to understand and comply with all applicable laws and regulations of Mauritius and any other destinations on your itinerary.
  • Reputation and damages: Briton Travel reserves the right to pursue legal action, including claims for damages to its reputation and any other remedies available, if a traveler’s illegal activities, or related conduct, cause harm to Briton Travel’s reputation, brand, or business interests. This includes, but is not limited to, unauthorized disclosures, defamatory statements, or actions that result in financial loss or brand damage to Briton Travel.

11. Photos, Videos, and Intellectual Property

  • Briton Travel reserves all rights to use any photos or videos taken during the trip for their social media, marketing, and other promotional purposes.
  • If you do not want us to use your photo, please do not appear in the photo, or request that your image be blurred before posting. You must communicate such requests clearly to us.
  • We may take photos and videos of participants and incorporate them into our promotional materials. By participating, you grant us permission to use such materials unless you have explicitly opted out as described above.

12. Damage to Property

We are not responsible for any damages to property caused by travelers, including hotels, venues, or other facilities beyond our direct control. Travelers are responsible for any damages they cause and may be liable for related costs or penalties.

13. Complaints

If you encounter any issues during your holiday, please inform the relevant supplier immediately. If the matter cannot be resolved, please contact our hotline or your sales agent. Timely communication is essential for us to investigate and rectify any issues.

14. Travel Insurance

We strongly recommend that all customers obtain comprehensive travel insurance to safeguard against unforeseen circumstances, including trip cancellations, medical emergencies, or lost luggage. It is your responsibility to arrange suitable travel insurance coverage.

15. Travel Advisories and Warnings

It is essential to stay informed about travel advisories and warnings issued by your government or relevant authorities for your destination. Please review and adhere to any travel restrictions, guidelines, or precautions provided.

16. Special Requests and Dietary Requirements

We understand that you may have special requests or dietary requirements. Please inform us in advance, and we will do our best to accommodate your needs. Please note that additional charges or limitations may apply.

17. Traveling with Children

If you are traveling with children, please ensure that you comply with any age restrictions or requirements for specific activities or accommodations. Parental consent forms may be necessary for certain situations.

18. Airline Seats

Standard seats are provided unless an extra seat is requested. If you require an additional seat for your comfort on the aircraft, please note that the request is not guaranteed. If confirmed, additional costs may apply.

19. Hotel Room

Standard beds provided in hotel rooms are of a standard size. If an additional bed is requested, please note that the available space in the room may be reduced.

20. Force Majeure and Unforeseen Circumstances

In the event of force majeure events, such as natural disasters, political unrest, or pandemics, our responsibilities may be affected. We will make every effort to assist you, but please understand that certain circumstances may necessitate changes to your travel arrangements or limitations on our liability.

21. Travel Warnings and Risks

It is important to be aware of potential risks associated with your chosen destination, including health risks, safety concerns, or cultural sensitivities. We strongly advise you to research and understand the risks before making your bookings.

22. Traveler's Responsibilities during the Trip

As a traveler, you are responsible for adhering to local laws, customs, and regulations during your trip. Please carry all necessary identification documents and behave responsibly and respectfully towards local communities and the environment.

23. Travel Agency's Liability

While we strive to provide excellent service, we cannot be held liable for any losses, damages, injuries, or disruptions incurred during your trip. Our liability is limited to the extent permitted by law. Please refer to our claims process for any issues that may arise.

24. Intellectual Property Rights

All materials provided by our agency, including itineraries, brochures, and website content, are protected by intellectual property rights. These materials should not be reproduced, distributed, or used without our prior written permission.

By booking your travel arrangements with us, you agree to be bound by these terms and conditions, as well as any additional terms and conditions applicable. It is your responsibility to ensure that the information provided is correct, and you are financially responsible for the use of our services.

Our knowledgeable agents are always available to provide detailed information, guidance, and support upon request to help make your preparations as seamless as possible.
